FSSAI stands for the Food Safety and Standards Authority of India, which is a regulatory body responsible for ensuring food safety and quality in India. To operate legally within the food sector in India, businesses must obtain either an FSSAI Registration or an FSSAI License, depending on the nature and scale of their operations.

FSSAI REGISTRATION

FSSAI Registration is typically required for small-scale, petty food business operator (FBO) or FBO having turnover of less than Rs 12 Lakhs.

The petty FBO who manufactures or sells food items, a hawker, little retailer, itinerant vendor, temporary stall-holder, or small-scale industries relating to food business who comply with the following conditions must obtain an FSSAI registration certificate.

  1. Annual turnover does not exceed Rs.12 lakh.
  2. Production capacity of food products (other than milk and milk products and meat and meat products) up to 100 liters or kg per day.
  3. Procurement or handling and collection of milk is up to 500 liters of milk per day.
  4. Slaughtering capacity is two large animals or ten small animals, or 50 poultry birds per day or less.
  5. Distributes foods including in any religious or social gathering except a caterer.

Documents Required for FSSAI Registration:

  1. Identity Proof: A government-issued ID (e.g., Aadhaar card, passport, etc.).
  2. Aadhaar Proof: Proof of the business address (e.g., utility bill, rental agreement, etc.).
  3. Business proof: Documentation proving the business activity (e.g., certificate of incorporation, partnership deed, etc.).
  4. Food Safety Management System Plan: A brief description of the food safety practices you follow.
  5. Declaration Form: A declaration form detailing your compliance with food safety regulations.
  6. Bank Details: For verification of the business’s financial stability.

FSSAI LICENSE

FSSAI LICENSE is mandatory for businesses having a turnover of more than 12 lakh or by the FBO engaged in food processing and manufacturing and they are having Import or export of the product. The FSSAI License is categorized into two types Central and State License.

  1. State License:
    This license is required for food businesses operating within a single state. It is typically issued to small and medium-sized enterprises (SMEs) that cater to a local or regional market. Businesses whose annual turnover is between ₹12 lakh and ₹20 crore are generally required to obtain a State FSSAI License.

  2. Central License:
    This license is required for food businesses that operate across multiple states or have a significant scale of operations. It is applicable to larger enterprises and those engaged in international trade.
    Businesses whose annual turnover exceeds ₹20 crore or those involved in the import or export of food products generally need a Central FSSAI License.
    The application for a Central License is submitted to the FSSAI’s Central Licensing Authority. This process involves a detailed evaluation of the business’s operations, including its supply chain, manufacturing processes, and compliance with food safety standards.

Documents Required for FSSAI Registration:

  1. Identity Proof: Similar to registration, government-issued ID.
  2. Aadhaar Proof: Proof of business address.
  3. Business proof: Documentation such as incorporation certificates, partnership deeds, etc.
  4. Food Safety Management System Plan: Detailed plan outlining food safety measures.
  5. No Objection Certificate (NOC): From the local municipal authority or health department.
  6. List of Equipment: Details of machinery and equipment used.
  7. Proof of Turnover: For businesses with a turnover above ₹12 lakh, proof of financials may be required.
  8. Manufacturing or Processing Details: Specifics about manufacturing and processing operations.

VALIDITY OF FSSAI LICENSE/ REGISTRATION

The FSSAI License / Registration will be issued for 1 to 5 years, as chosen by the Food Business Operator (FBO), from the date of issue of registration or license. The FBO must apply for renewal 30 days before the expiry Term.
