Procedure to Apply for Copyright Registration in India:

  1. Application Form:
    • Form XIV: This is the prescribed form for copyright registration in India.
    • The form can be filled out online through the Copyright Office's website or manually.
  2. Supporting Documents:
    • Work to be Registered: A copy of the work for which copyright is sought (in physical or digital form). For example, manuscripts, music compositions, artistic creations, etc.
    • NOC form Author (if applicable): If the author and applicant are different, a No Objection Certificate (NOC) from the author is required.

    • NOC from Publisher (if applicable): If the work is published and the applicant is different from the publisher, an NOC from the publisher is required.
    • Assignment Deed (if applicable): If the applicant is not the author but has obtained rights through an assignment, a copy of the assignment deed is required.
    • Authorship Prof: Identity and address proof of the author (applicant).
    • Statement of Particulars: Details of the work, including title, year of publication (if published), language, etc.
  1. Filling The Application:
    • The complete application form along with the supporting documents and prescribed fee must be submitted to the Copyright Office.
    • Applications can be filed physically or online through the Copyright Office’s e-filing facility.
  2. Examination:
    • The Copyright Office will examine the application to ensure it complies with the requirements under the Copyright Act, 1957.
  3. Issuance of Copyright Certificate:
    • If the application is approved, the Copyright Office will issue a Copyright Registration Certificate.
    • The process typically takes several months from filing to issuance of the certificate.

Important Points:

    • Fees: The fee structure for copyright registration varies based on the type of work and mode of filing.
    • Validity: Copyright protection lasts for the lifetime of the author plus 60 years after their death. For anonymous and pseudonymous works, cinematographic films, sound recordings, photographs, posthumous works, works of government, and works of international organizations, the duration of copyright varies.
    • International Protection: Copyright registration in India provides protection within the country. For international protection, India is a member of the Berne Convention and Universal Copyright Convention, and copyright protection can be sought in other member countries through reciprocal agreements
